The processing of your personal data should be in accordance with the law, fair and transparent, so we want to inform and ask for why and on what terms we process personal data, including making you aware of the rights related to the processing of personal data and how to implement them. This is one of the elements of the implementation of the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC , commonly referred to as the Regulation on the Protection of Personal Data ("RODO").

iSmoking determines the purposes and methods of processing your personal data, therefore it is responsible for their processing in accordance with the law, including the GDPR, which protects the fundamental rights and freedoms of individuals, in particular the right to personal data protection.

5. Goals and basics of processing your personal data
The purpose of data processing is the conclusion and performance of a contract to which you are a party or take action before entering into a contract, including: sale of goods or services, provision of electronic services, e.g. newsletter, account servicing on the iSmoking.pl service, implementation of loyalty programs, expressing opinions, ratings or comments, handling of various requests (eg via the online contact form), as well as ongoing contact with you in the above field. In such cases, the basis for data processing is their indispensability to perform the contract or to take the necessary actions before concluding the contract (Article 6 (1) b of the RODO).
In connection with the above, in accordance with the applicable provisions, the basis for data processing will also be their necessity to fulfill the legal obligation of iSmoking (Article 6 paragraph 1 c) and, in particular: issuing and storing invoices and accounting documents, handling complaints, providing data to state authorities within the limits and on the basis of legal regulations, e.g. for tax and accounting purposes.
We also process your personal data for the purposes set out below, based on the legitimate interest of iSmoking (Article 6 paragraph 1 f of the RODO):
improving the quality of goods or services sold by iSmoking by seeking opinions or satisfaction surveys on this subject;
activity management on iSmoking websites, through its monitoring, in terms of improving the service functionality, needs analysis, matching ads in accordance with previously viewed content;

6. Is the provision of data mandatory?
Providing your personal data is a condition for the conclusion of the contract. If required by law, we may require the data required by these regulations, e.g. NIP. Refusal to provide data to the extent necessary to conclude or perform the contract and to the extent required by law will prevent it from being short-circuited. In the case of collecting personal data on the basis of consent, providing personal data is voluntary.

7. Who besides iSmoking has access to your personal data?
Due to the processing of data in the purposes and on the grounds described above (point 5), personal data may be made available to the following categories of recipients: entities providing marketing services to entities handling our teleinformation systems or supporting these systems; public authorities or entities performing public tasks. supplier of software needed to run an online store; entity carrying the delivery of goods; payment provider; accountant; host entities cooperating with us under civil law agreements, supporting our current activity is an entity providing statistical services8. As long as we store your personal data, we will process your data only for the period during which we will have a legal basis, ie until: we are no longer under legal obligation, obliging us to process your data, the possibility of determining, investigating or defending possible claims related to the agreement concluded by the Store by the consent to the processing of data, if it was its base, your opposition to processing your personal data - if the basis for processing your data was the legitimate interest of the administrator or if the data was processed for direct marketing9 . Information about profiling your data. For the purposes described in point 5, with the exception of processing in order to fulfill the legal obligation, we will profile your personal data, i.e. automatically analyze it, to obtain information about preferences or interests (eg to examine what offer may best suit you). This processing will not have legal effects or have a similar effect on you.10. Your rights to data processing All persons whose personal data is processed by iSmoking have the following rights resulting from the GDPR: the right to access personal data (information about the data processed by iSmoking, including the right to obtain a copy of this data); rectification (correction) of personal data when the data is incorrect or incomplete, the right to request the deletion of personal data (the so-called "right to be forgotten") when: data is no longer necessary for the purposes for which they were collected or otherwise processed , the data subject has objected to the processing of the data, the data subject has withdrawn the consent on which the processing is based and there is no other legal ground for processing, the data is processed unlawfully, the data must be removed in order to comply from the obligation resulting from the provisions of law, the right to demand a restriction processing of personal data when: the data subject questions the correctness of personal data, data processing is unlawful and the data subject opposes data deletion, demanding instead to limit them, the administrator no longer needs data for his or her data purposes, but the data subject needs them to identify, defend or pursue claims, the data subject has objected to the processing of the data - pending determination of whether the legitimate grounds on the part of the controller override the grounds of objection; transfer of data to another administrator or to you (on the terms set out in Art. 20), if you have consented to the processing of your personal data, you have the right to withdraw it at any time (withdrawal of consent does not affect the lawfulness of processing which was made on the basis of consent before its withdrawal). at the time you may object - for reasons related to your particular situation - to the processing of personal data based on a legitimate interest of iSmoking or public interest (Article 6 paragraph 1 eif of the RODO), including profiling based on these provisions. iSmoking will no longer process your personal information unless we demonstrate that there are valid legitimate grounds for processing that override your interests, rights and freedoms, or demonstrate that there is a basis for determining, investigating or defending claims. If we process your personal information for marketing purposes You have the right at any time to oppose the processing of personal data for such marketing purposes, including profiling, to the extent that the processing is related to such direct marketing. After filing the objection, we will no longer process your data for such purposes. The implementation of these rights will help you submit your application to the address indicated in point 4 of this information.
